TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYHEALTHSENTRY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES.

9. Indemnification

You agree to indemnify and hold harmless MyHealthSentry and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

12. Charity Competitions and Donations

MyHealthSentry offers charity-backed competitions in which participants commit to pledge a donation to a nonprofit chosen by the competition organizer. By participating in or organizing a charity competition, you agree to the following:

  • Donations are voluntary. Pledging is an honor-system commitment; MyHealthSentry does not automatically charge any payment method.
  • Payments are processed by Pledge.to, an independent third-party donation platform. MyHealthSentry is not a party to the donation transaction and does not handle your payment information.
  • MyHealthSentry receives no portion of donations. The full donation, less any payment-processing fee charged by Pledge.to or its payment processor, is delivered to the recipient charity.
  • Tax-deductibility of any donation depends on the recipient charity's status, your jurisdiction, and applicable tax law. MyHealthSentry makes no representations about deductibility. Tax receipts, if any, are issued by Pledge.to or the recipient charity.
  • Refunds and disputes are handled by Pledge.to per Pledge.to's own refund policy. MyHealthSentry cannot reverse a completed donation.
  • Your use of Pledge.to is governed by Pledge.to's terms of service (https://www.pledge.to/terms) and privacy policy (https://www.pledge.to/privacy).

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
